It was evident at the time, and increasingly since, that the move to the invasion of Iraq commenced with the visit of Tony Blair to Crawford in April 2002. Recent speculation and leaks shows that the Whitehall legal dovecotes were flapping as a result of the leader’s chummy get together in sunny Texas. (Remember of course that Bill Gemmell, Scottish Rugby hero and Tony’s debating partner at Fettes, whose dad helped fund Dubya’s dads Zapata Oil shared holidays with the youthful Dubya at the family’s estate in Renfrew and the Bush’s compound at Kennebunkport – the Gemmells went on to pull Dubya’s chestnuts from the financial fire when Arbusto Energy finally sank in the Gulf of Mexico.)
God knows what Mephistophelian bargain our Dear Leader struck then, but it stuck. The simplest reading of the UN Charter demonstrates that the invasion in March 2003 of Iraq was illegal – as confirmed subsequently and simply by the Secretary General. Now the whole enterprise is unravelling hourly, as the isolated and increasingly desperate Goldsmith, as honest as any lawyer gets, seeks to explain and the Dear Leader exerts even greater pressure to conceal the Truth.
Now the Prime Minister wants, nay needs, to steamroller legislation to crush dissent, freedom and liberty of his subjects, by introducing the revised Prevention of Terrorism Bill that his Neanderthal Home Secretary introduced in the House of Commons on 22nd February 2005.
“The Secretary of State may make an order (called a “control order”) against an individual if he has reasonable grounds for suspecting that the individual is or has been involved in “terrorism-related activity”. “
Whilst the credulous press and the less than sedulous legislators worry their pretty little heads over the role of the Secretary of State and the self important Judiciary, the entirely novel concept of “terrorist related activity” is nowhere defined, debated or discussed… “It is like an elephant guv, I can’t explain it, but you’ll know one when you see one!”
Not only is this hitherto undescribed and unknown activity to be legislated for – it must be done without delay, peradventure as the romantic novelists would say. “…we introduced new anti-terrorism measures in 2001…however, the Law Lords, in an eight-one judgment last year, found that they were both disproportionate and discriminatory” as the Dear Leader explained why further disproportionate and discriminatory legislation was required without delay.
Cast our minds back to exactly the 28th February 1933. The previous night allegedly, a raging, drunken Communist had burnt down the Reichstag and the obedient, helpful and well prepared Carl Schmitt, the Ashcroft or Charles Clarke of the Weimar republic had some legislation ready he had prepared earlier, the Reichstagsbrandverordnung or more correctly Verordnung des Reichspräsidenten zum Schutz von Volk und Staat the Decree of the Reich President for the protection of people and state). “Humanity,” Schmitt wrote in a typically terse formulation that is brilliant if you admire it and chilling if you do not, “cannot wage war because it has no enemy.” A pretty conceit in The Concept of the Political (”Der Begriff des Politischen”), which was Schmitt’s ultimate statement that there is an ENEMY, that you must have an ENEMY. The treatise formed, according to its leading commentator in an essay accompanying the book and perhaps the most read and astute commentator of this infamous text, ‘an inquiry into the “order of human things”, into the State.’ The commentator – Leo Strauss a non practising Jew, who Schmitt (who in May In May 1933 joined the Nationalsozialistische Deutsche Arbeiterpartei NSDAP), the non practising Catholic was able to provide with a Rockefeller scholarship to escape Germany and eventually end up at the University of Chicago, the mentor of the whole crowd of academic neo-cons and their hangers-on who penned and published the sinister Project for the New American Century.
It took the Weimar Government one day to pass the Reichstagsbrandverordnung and minutes for Hindenburg to add his shaky signature.
On March 2nd 1933 Hitler (facing an election in 22 days) a correspondent of the Daily Express asked him whether the suspension of liberties was permanent. He answered in the negative saying that full rights would be restored as soon as the Communist danger was over. The reality was that the decree of February 28th established what would become the normal order of things under National Socialism – arrest on suspicion, imprisonment without trial, the horrors of the concentration camps. This condition would persist until the end of the Third Reich
Tony Blair (facing an early election) had an article published in his name in the Daily Telegraph on 24th February 2005 with the title, “I’m not being ‘arrogant’ – I’m being responsible for our safety”. Pregnant with personal pronouns it starts…” I have absolutely no doubt about the main duty of any prime minister: it is to do everything possible to protect the security of our nation and its citizens. Following September 11, I had hoped that everyone – and certainly every responsible politician – would understand that this is more important than ever. … “There is no greater civil liberty than to live free from terrorist attack… There is no limit on the levels of murder and destruction they (this new breed of terrorists) want to inflict, on the weapons they will use or on their targets. Careful readers who seek to find if the suspension of our historical freedoms and liberties conferred upon the Government either by Ministerial fiat or judicial decision, both based upon the “evidence” of the secretive services and Police are not permanent will be sadly disappointed.
