Can international law provide justice for Palestinians?
What has been happening in Gaza cannot usefully be described as “warfare”. The daily reports of atrocities situate this latest Israeli assault on common humanity within the domain of what the great Catholic thinker and poet, Thomas Merton, caIled “the unspeakable”. Its horror exceeds our capacity to render the events through language.
The events in Gaza are essentially a repetition of prior Israeli incursions with heavy sophisticated weaponry in which the people of Gaza are the helpless victims of Israeli firepower, with no place to hide, and increasingly without even such necessities of life as water and electricity, whose facilities have been targeted by Israel’s precision weaponry.
By now we should all understand that one-sided violence whether in the form of torture or state terror is criminal behaviour. When it leads to many civilian deaths on one side and few civilian casualties on the other side, then such state terror is best characterised as a massacre, epitomised by the high civilian death toll on July 20 in the Gaza City neighbourhood of Shujayea where a crowded residential district was repeatedly shelled by heavy IDF artillery. The latest casualty figures on the Palestinian side are more than 600 killed, over 3,000 injured, 75 percent of whom are estimated to be civilians. On the Israeli side, 29 killed, all but two were soldiers. As with earlier massive Israeli military operations carried out against the people of Gaza 2008-2009, and 2012, the defenceless Gazan population is again being cruelly victimised. If an adversary of the West was behaving as Israel has since July 8, it would be branded an aggressor whose leaders would likely be held accountable before the International Criminal Court (ICC) or some other tribunal with the authority to prosecute persons accused of international crimes which have distressed the US government and its allies. — See also:INTERACTIVE: Gaza Under Attackmore..e-mail

Her name is Katie. She is from the Netherlands, and chose to serve in the Israeli navy instead of remaining in her country.
Will her government label her and the rest of the hundreds of Dutch youth serving in the Israeli military as jihadstrijders (jihad fighters), the name given to the hundred or so that went to Syria? Katie, a Dutch-Israeli dual citizen, is after all a jihadist in occupied Palestinian lands.
Israel’s genocidal campaign in the Gaza Strip is entering its second week. The death toll has risen to more than 600, with thousands more injured and displaced – alongside arbitrary arrests, the demolition of family homes and a policy of apartheid towards Palestinians both in the West Bank and within the state of Israel. What’s more, these war crimes are directly supported by the recruits from Europe and the United States that land at Ben Gurion airport throughout the year.
The notion of Europeans and Americans serving in the Israeli army isn’t new.
Before the creation of the state of Israel, thousands of western volunteers were recruited by the Zionist movement – in a process named Mahal or volunteers from abroad to take part in Zionist military operations in Palestine during the British Mandate.

The truth about Israel s new war on Gaza the energy rush

While Israel has deployed its media machine, telling the world that it has the right to defend itself against foreign aggression, arguing that no country should ever be made to tolerate systematic terror, even though under international law such narrative holds no legal ground as Israel has been de facto occupying Gaza, rendering null and void the notion of Gaza as a foreign entity, little has been said of Israel’s real motives.
To quickly settle Israel’s argument that it legally and morally can and should defend itself against any aggression coming from Gaza, it is important to understand that the Gaza Strip is not, under international law, a sovereign state, it is an occupied land, therefore Israel cannot declare war on its people, rather it owes its people protection.
As explained by Nura Erakat in a report published in Intifada Palestine, “Military occupation is a recognised status under international law and since 1967, the international community has designated the West Bank and the Gaza Strip as militarily occupied. As long as the occupation continues, Israel has the right to protect itself and its citizens from attacks by Palestinians who reside in the occupied territories. However, Israel also has a duty to maintain law and order, also known as ‘normal life’, within territory it occupies. This obligation includes not only ensuring, but prioritising, the security and well-being of the occupied population. That responsibility and those duties are enumerated in Occupation Law.”
As for Palestinians in Gaza they do however have an inherent right to resist foreign occupation. Such right is again, protected under international law.
But as the following arguments will attempt to demonstrate all the above, the contradicting narratives, the political manipulations and media campaigns, are but a distraction from far more pragmatic realities and maybe truth the war on Gaza has little to do with sovereignty, terror, politics or even religion, rather it has everything to do with energy.more..e-mail

In March 1955, an Israeli army unit attacked a camp belonging to the Egyptian army inside the Gaza Strip, which was entrusted to Egypt after the 1948 war. The Israelis killed 36 Egyptian soldiers in cold blood and wounded 28 others. One of the perpetrators was the infamous Ariel Sharon, the late Israeli prime ministe
r, who said that the purpose of the operation was “to kill all the soldiers, destroy all the weapons that were available inside the camp and destroy its entire installations.” According to a once-secret Israel report made public a few years ago, it was a punitive objective, not military, “to deliver a message to the Egyptian leadership under Gamal Abdel Nasser that any new commando operation [by Egypt] will have bloody consequences.”
Nasser learned the painful lesson and called off the operations that were carried out by Egyptian intelligence units. Such operations have always puzzled historians because during that same period he was in contact with Israeli Prime Minister Moshe Sharett about making peace between the two countries. The Egyptian president later tightened his iron grip on Gaza and prevented and pursued any Palestinian who contemplated resistance. Compare that with the current situation in the Gaza Strip.
Israel’s first Prime Minister, David Ben-Gurion set up a military doctrine for his country to deal with the surrounding Arab states which did not recognise it; he called this “incremental deterrence”. The doctrine did not tolerate any resistance operations and responded with incremental and brutal force so that the Arab states would realise that they have no choice; they could accept or reject Israel, but they had to stop all forms of resistance. The result was the same either way. Israel does not need the love of the Arabs nor does it need to convince them of its right to exist in their midst. It knows that its existence is outside the context of history and logic and that it came into being by force, it will live by force and it will die by force.
